• Any bugs, viruses, or other harmful code that may be transmitted to or through the Service by any third party.

15. Miscellaneous

• Entire Agreement: These Terms constitute the entire agreement between you and Merakku.ai regarding the use of the Service.
• Waiver and Severability: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in effect.

• Notices: Any notices or other communications provided by Merakku.ai under these Terms, including those regarding modifications to these Terms, will be given: (i) via email; or (ii) by posting to the Service. • Force Majeure: Merakku.ai will not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to acts of God, war, strikes, or other labor disputes, embargoes, government orders, or any other force majeure event.
• No Third-Party Beneficiaries: These Terms do not confer any third-party beneficiary rights.
• Headings: The headings in these Terms are for convenience only and have no legal or contractual effect.

16. Beta Services

From time to time, Merakku.ai may invite you to try, at no charge, products or services that are in beta or pre-release stages ("Beta Services"). You may accept or decline any such trial in your sole discretion. Beta Services are provided "as-is" without any warranties, and they may be subject to additional terms.

17. Feedback

We welcome and encourage you to provide feedback, comments, and suggestions for improvements to the Service ("Feedback"). You may submit Feedback by emailing us at info@merakku.ai. You acknowledge and agree that all Feedback will be the sole and exclusive property of Merakku.ai, and you hereby irrevocably assign to Merakku.ai all of your rights, title, and interest in and to all Feedback.

18. Dispute Resolution

• Informal Resolution: Before filing any claim against Merakku.ai, you agree to try to resolve the dispute informally by contacting us at info@merakku.ai. We'll try to resolve the dispute informally by contacting you via email. If a dispute is not resolved within 30 days of submission, either party may bring formal proceedings.
• Arbitration Agreement: For any dispute you have with Merakku.ai, you agree to first contact us and attempt to resolve the dispute with us informally. If Merakku.ai has not been able to resolve the dispute with you informally, we each agree to resolve any claim, dispute, or controversy (excluding claims for injunctive or other equitable relief) arising out of or in connection with or relating to these Terms by binding arbitration by the American Arbitration Association ("AAA") under the Commercial Arbitration Rules and Supplementary Procedures for Consumer Related Disputes then in effect for the AAA, except as provided herein.
